Return and Refund Policy

There are a few important things to keep in mind when returning a product you purchased online from BrainBit Inc. Please read this policy carefully to understand your rights and responsibilities.

Subject to applicable law in the United States and the State of California: 

• You have the right to cancel your order within 15 days without explaining the reason.In order to use your right to cancel an order, you must inform us of your decision by means of a statement with all purchase data, including order number and all items Serial Numbers.

Return Conditions

The full cost of the product is returned within 10 days from the completion of QA inspection by BrainBit Inc. on condition:

• Only items that have been purchased directly from BrainBit, either online or at any BrainBit affiliate partner, can be returned to BrainBit. BrainBit products purchased through other retailers must be returned in accordance with their respective returns and refunds policy;

• Availability of proof of purchase;

• The item is in the original packaging;

• The item you are returning is repackaged with all the cords, adapters and documentation that were included when you received it;

• The BrainBit device and its components are not damaged (without defects, scratches, and other shortcomings/damages resulting from operation);

• The tare/packaging of items is not damaged;

• The item is returned complete with all original accessories that were included in your original purchase;

Restocking Fee:

If you have used any accessories with the device during the return period (such as replacement caps, electrodes, or electrode wires), a restocking fee of 15% of the device cost will be deducted from your refund. This fee applies only to non-warranty returns and compensates for the cost of used consumable items. Restocking fees do not apply to warranty claims or manufacturer defect replacements.

If you believe your product is defective within the warranty period, you should contact BrainBit Inc. customer support to obtain a Warranty Return Authorization and obtain a Return Materials Authorization number before the end of the applicable return period.

*Except for the return rights set forth in this section, all sales are final and you are not entitled to return items if the BrainBit items have no defect.

How to Return Your Product

Follow these steps to initiate a return:

• Send an email to support@brainbit.com and copy info@brainbit.com

• Include the following in your email:

• Photo(s) of the product

• Serial Number (SN)

• Detailed explanation of the issue or reason for return

• Our support team will contact you to diagnose the issue and may attempt to resolve it remotely.

• If the device cannot be fixed remotely or parts need to be replaced, we will ship you a replacement device and provide a prepaid return label (either with the replacement or separately) to return the original device. Your return address will be provided via email after verification and approval of your return request.

Non-Refundable Items

The following items and services cannot be refunded:

• Сustom-made Goods made in accordance with your requirements or clearly according to an individual order;

• Software purchases cannot be refunded unless you return all devices for which the software was purchased;

• Shipping costs are non-refundable, except in cases of warranty claims or manufacturer defects where BrainBit provides a prepaid return label.

Conditions for Refund Ineligibility

BrainBit will not process a refund or replacement if any of the following apply:

• The device was used outside of its intended purpose or misused, neglected, or improperly handled;

• The device was modified without BrainBit’s authorization;

• You violate the requirements of applicable law or the terms of service governing BrainBit products;

• You commit dishonest, illegal, or prohibited actions, including providing false information or infringing on intellectual property rights through copying, processing, or redesigning BrainBit products or components without consent;

• No reason or incomplete information is provided for the refund request.

We reserve the right to refuse the return of any item that does not comply with BrainBit’s Return Policy.

International Returns and Duties

International customers are responsible for all customs duties, Value Added Tax (VAT), and tariffs associated with returning products to BrainBit. This includes return shipping costs unless the return is due to a manufacturer defect or warranty claim, in which case BrainBit will provide a prepaid return label. Please be aware that import/export duties may apply depending on your country of residence and the country of origin of the product.

Goods Returns

You are solely responsible for the costs and risks of damage associated with returning Goods to us. 

We are not responsible for items that are damaged or lost during return shipping. Therefore, we recommend choosing a secure and traceable delivery service. We cannot issue a return without actually receiving the item or proof of return shipping received.

Damages and Issues

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Product Evaluation and Responsibility for Damage

All returned or exchanged items will be subject to an evaluation by BrainBit Inc. to determine the cause of any malfunction or physical issue. Products found to have manufacturer defects or material faults under normal usage conditions will qualify for a full refund, replacement, or warranty repair, as applicable.

However, BrainBit Inc. will not refund, replace, or exchange products that are found to be damaged due to misuse, neglect, unauthorized modifications, improper handling, or use outside of the device’s intended purpose.

Refunds

Once we receive your item, inspection begins immediately. A refund is initiated within 5 days after QA inspection is completed. If you canceled a pickup item and were billed for it, we initiate your refund immediately after you submit your cancellation request. The way your refund is processed depends on your original payment method:

If you paid by credit or debit card, refunds will be sent to the card-issuing bank within 10 business days of the refund initiation. Please contact the card-issuing bank with questions about when the credit will be posted to your account.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@brainbit.com.

Your return address will be provided via email after your return request is verified and approved by our support team.

Manufacturer’s warranty

• Warranted period of operation: 12 months

• Warranted period of storage: 6 months from date of production

In the event that repair or correction of defects is necessary during the warranted period, the warranty is extended by the amount of time for which the device is not available for use due to the defect or malfunction. If the device is replaced in its entirety, the warranty period is renewed from the date of the replacement. Warranty repair of the device is carried out at the cost of the seller/manufacturer. After expiration of the warranty, the cost of repairs is borne by the purchaser of the device. If a warrantied device ceases to function due to improper operation, then the cost of repairs is borne by the purchaser.
